These Terms and Conditions (“Terms”) govern your use of the services and products provided by Arms of Old Archery, located in Devon, UK. By engaging with our services, purchasing our products, or visiting our facilities, you agree to abide by these Terms. Please read them carefully.
1. General Terms1.1 Eligibility:
Our services and products are intended for individuals aged 18 and older. Minors under 18 must be accompanied by a legal guardian who accepts full responsibility for their safety and compliance with these Terms.
1.2 Safety First:
Safety is our utmost priority. All customers must adhere to the safety guidelines provided by our instructors or outlined within our facility. Failure to comply may result in immediate expulsion from the premises without a refund.
1.3 Health and Fitness:
Archery requires a certain level of physical fitness. By participating, you confirm that you do not suffer from any medical condition that could put you at risk or hinder your ability to safely engage in archery activities. If in doubt, consult with a medical professional before participating.
2. Bookings and Cancellations2.1 Bookings:
All bookings must be made in advance, either online, by phone, or in person. Full payment is required to secure your reservation. We reserve the right to vary these conditions on a case by case basis
2.2 Cancellation Policy:
- Cancellations more than 72 hours in advance: Full refund or rescheduling at no additional cost.
- Cancellations within 72 hours: 50% refund.
- No-shows or cancellations on the day: No refund.
2.3 Group Bookings:
Special terms may apply to group bookings (6 or more participants). Please enquire.
2.4 Changes by Us:
In rare circumstances, we may need to cancel or reschedule your booking due to unforeseen events (e.g., extreme weather conditions, instructor availability). In such cases, you will be offered a full refund or the option to reschedule.
3. Products and Services3.1 Product Sales:
All product sales (including bows, arrows, and accessories) are final. We do not accept returns or exchanges unless the item is defective. In such cases, please contact us within 14 days of purchase for a replacement or refund. No refunds will be made until defective items are returned to us.
3.2 Rentals:
Equipment rentals are available for use during your booked session and the cost of this will be included in your booking fees (unless expressly excluded in additional terms and conditions). All rented equipment must be returned in the same condition as received. Any damage or loss of equipment will result in a fee equal to the cost of repair or replacement.
3.3 Instruction and Training:
Our instructors are qualified professionals who will provide guidance and training during your session. However, the outcome of your training (e.g., skill improvement) is not guaranteed and depends on individual effort and practice.
4. Liability4.1 Assumption of Risk:
By participating in archery activities, you acknowledge the inherent risks involved, including but not limited to physical injury. You agree to assume full responsibility for these risks (also see 4.2).
4.2 Liability Waiver:
Arms of Old Archery, its employees, and affiliates are not liable for any injury, loss, or damage that may occur as a result of your attendance at our premises and/or participation in our activities or use of our products, except in cases of gross negligence or wilful misconduct.
4.3 Personal Belongings:
We are not responsible for any loss or damage to personal belongings while on our premises. Please ensure that your valuables are secured at all times.
5. Code of Conduct
5.1 Respect and Courtesy:
All participants are expected to treat instructors, staff, and fellow participants with respect and courtesy. Disruptive or abusive behaviour will not be tolerated and may result in immediate removal from the premises without a refund.
5.2 Alcohol and Drugs:
The consumption of alcohol or drugs before or during your session is strictly prohibited. Anyone suspected of being under the influence will be asked to leave without a refund.
5.3 Facility Rules:
Please follow all posted rules and regulations within our facility. Failure to do so may result in expulsion from the premises without a refund.
6. Privacy and Data Protection
6.1 Personal Data:
We collect and store personal data in accordance with UK data protection laws. Your data will be used solely for the purpose of managing your bookings, providing services, and communicating with you. We do not share your data with third parties without your consent.
6.2 Marketing:
By providing your contact information, you agree to receive occasional promotional emails from Arms of Old Archery (unless you have indicated that you with to opt out). You may also opt out at any time by clicking the “unsubscribe” link in any email or by advising us in writing (by email or post)
7. Amendments7.1 Changes to Terms:
We reserve the right to amend these Terms at any time. Any changes will be communicated via our website or email and will take effect immediately upon posting.
7.2 Continued Use:
Your continued use of our services following any changes to these Terms constitutes your acceptance of the revised Terms.
8. Governing Law
8.1 Jurisdiction:
These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
